The Mistercredito Online Shop is managed by Boomerang, a company specialised in the distance selling of trademark-derived products. Today, Boomerang is essentially involved in selling trademark-specific merchandise, although product categories are likely to develop in the future.
The aim of these general conditions is to define the sales procedures between Boomerang company and its customers defined below. Pursuant to these conditions, a customer is anyone who places an order on the www.mistercredito.com site.
These general conditions of sale govern the sale of products found on www.mistercredito.com on the day on which the order was placed. They apply when the order was placed via the Internet. Should these terms vary according to the ordering method, said differences will be noted in a specific manner.
Customers ordering via the La Boutique en Ligne Mistercredito Internet site in the French or English language are deemed to be buying in France and hence are subject to French law.
As the purchase of a product found on the La Boutique en Ligne Mistercredito site is not an everyday act of management, pursuant to article 1124 of the Civil Code, any customer of La Boutique en Ligne Mistercredito declares having the capacity to contract to the terms and conditions described below, i.e. to be an emancipated minor or of legal age and not protected under the terms of article 488 of the Civil Code.

Ticking the box “I have become familiar with the general conditions of sale and I agree to them”, before validating the order, automatically implies the express acceptance of said general conditions of sale of the person having acknowledged taking cognizance thereof. These conditions apply to the exclusion of any other conditions, failing written agreement signed by both parties.
These general conditions of sale can be modified at any time; the customer is thus invited to read them regularly. Each version of these conditions has a precise date, the orders are thus governed by the general online conditions on the date of ordering.

La Boutique en Ligne Mistercredito is in no case responsible for any erroneous data transmitted by the manufacturers. A confirmation of the technical details is always possible by calling the Boomerang company’s Sales Department, or by sending an electronic mail. Failing information to the contrary specified on the site, all products sold by La Boutique en Ligne Mistercredito are new. The products on offer comply with the European legislation in force and the standards applicable in Europe.
Prices are indicated in euros, all tax inc., and are exclusive of postal and order preparation charges. As the prices of the company’s suppliers are in constant change, the prices displayed on the site are subject to modification at any time. They could also show a variation owing to launch prices, special offers and sales. All prices are provided subject to obvious typographical errors.
VAT is applied to sales concluded with residents of the European Union. It does not apply to non-French companies of the European Union in possession of an intra-community VAT number.
The VAT rate applied depends on the country of delivery. The rate is, in percentage of the value of the goods sold, 19.6% for delivery in Metropolitan France, Corsica and Monaco.
There are no customs duties inside the European Union. Customs duties eventually apply to goods sold from the European Union to the customer country. In this case, it is up to the latter to pay these customs duties and any eventual associated administrative aspects. The liability of the vendor stops when the product has been sent to the address specified by the customer. As a reminder, French Overseas Territories are considered to be outside the European Union and hence subject to customs clearance.
Order preparation and transport charges are added to the total price (all tax inc.) and are all inclusive: €10 for France, €17 for the other European Union countries and €30 for countries outside the European Union.
On occasion, postal charges could be offered within the framework of marketing operations
Orders are placed directly with La Boutique en Ligne Mistercredito via the www.mistercredito.com site.
They enter their details themselves on an appropriate form. Customers are invited to reread their forms before validating their orders. La Boutique en Ligne Mistercredito is responsible neither for electronic mail send nor parcel send errors due to an incorrectly completed form.
An automatic email order confirmation is sent to the customer subject to the accuracy of the email address the latter specified in the order form.
Customers can cancel their orders at any time, as long as they have not yet been billed.
In this case, and if the customer really does not want the products he has ordered, he must refuse the parcel on receipt, i.e. send it back without opening it with the words "parcel refused". He will be refunded the amount of the order by transfer, minus the postal and order preparation charges

In fact, depending on the case, the products are available within the limit of stocks available at La Boutique en Ligne Mistercredito or subject to Mistercredito supplier stock availability.
Should La Boutique en Ligne Mistercredito fail to obtain a product from its suppliers, it notifies the customer of the scheduled delay by electronic mail. The latter can then choose to cancel his order on the basis of this new information. No cancellation penalty is applied for an order cancellation of this type.
The customer can pay by credit card or Carte Aurore.
The customer guarantees La Boutique en Ligne Mistercredito that he disposes of the required authorisations to use the method of payment he has chosen.
La Boutique en Ligne Mistercredito reserves the right to refuse to make a delivery or honour an order from a customer who failed to make partial or total payment of a previous order, or with whom a litigation process is underway.
The information specific to a customer order is the object of automated data processing under the responsibility of Boomerang. The aim of this automated processing is to define a transaction analysis level and to fight against credit card fraud.
Boomerang and La Boutique en Ligne Mistercredito are recipients of the data specific to the customer order. The non-transmission of this data prevents the execution and analysis of your transaction.
In compliance with the Freedom of Information Act of 6 January 1978, you have the right to access, rectify and oppose all of your personal data, and this at any time, by writing by mail and justifying your identity to shopcredito@agencecosmic.com.
Moreover, within this framework, La Boutique en Ligne Mistercredito may have to ask the customer for all documents required to unblock the order: proof of residence, identification, etc.
La Boutique en Ligne Mistercredito remains the owner of the goods delivered until their complete payment by the customer.
The provisions above do not form an obstacle, as of delivery of goods, to the customer transfer of the risk of loss of goods, or their deterioration subject to reservation of title clause together with the damages that they could cause.
The online purchase order drawn up by the customer is not equivalent to a bill. The customer is considered to be billed as soon as the parcel is ready for shipping.
The customer receives his bill during delivery, in his parcel.
La Boutique en Ligne Mistercredito keeps a digital copy of each bill.
The orders placed via Internet are recorded every morning, from Monday to Friday. The company then processes, in one day, these orders from the previous day.
Generally speaking, for an in-stock product and credit card purchase, the customer should allow two days for order preparation (order processing, billing, product preparation, packaging) before shipment.
La Boutique en Ligne Mistercredito informs the customer that transit times are those transmitted by the carriers. It simply passes on this information to the customer for information only and hence can no way be held responsible in the event of non-respect of said transit times.
Moreover, La Boutique en Ligne Mistercredito wishes to make it clear to the customer that these transit times do not include Sundays and bank holiday.
When placing an order, these transit times are referred to in the purchase order.
If La Boutique en Ligne Mistercredito has the product in stock, the delivery time is equal to the order preparation time plus the transit time.
If La Boutique en Ligne Mistercredito does not have the product in stock, the company’s restocking time of said product should be added to the preparation time and transit time.
Once the initial delivery time announced has been exceeded, the customer will be informed of the new delivery time, based on the information known by La Boutique en Ligne Mistercredito. In any case, a cancellation and/or refund option will also be proposed.
The products to be shipped are packaged in accordance with the relevant standards. The procedures and techniques employed are open-ended with a view to the general optimisation of packaging.

La Boutique en Ligne Mistercredito is not responsible for any bugs which could hamper the possibility offered to customers allowing them to track their parcels on the hauliers’ Internet sites.
The products are delivered by default to the address specified by the customer on the purchase order.
Depending on the case, the haulier can leave a non-delivery notice in the customer’s mailbox, inviting him to contact the post office or depot nearest his residence, or to make an appointment.
There is always a possibility that a parcel may fail to arrive within the allotted timeframe guaranteed by the post office or the hauliers. If the post office is concerned, get in touch with your nearest post office. In all cases (post office or haulier), if the delay is very considerable, the customer can then contact La Boutique en Ligne Mistercredito with a view to investigating the whereabouts of the parcel. The parcel could in fact be lost.
In that case, La Boutique en Ligne Mistercredito is obliged to comply with the timeframe imposed by the post office, or the hauliers, insofar as concerns the declaration of loss and refund of the shipment. To this end, the customer is also held to these deadlines:
- The customer has a maximum of 10 working days, as from receipt of the parcel shipment confirmation email, to declare the loss of said parcel to La Boutique en Ligne Mistercredito. Beyond this deadline no claim will be taken into account.
- If the customer should make a lost parcel declaration within the above 10 working-day deadline, La Boutique en Ligne Mistercredito will ensure that a claim file is drawn up. Within this framework, it may request documents of the customer, necessary to the preparation of said file.
- Finally, the definitive replies concerning the investigations are given by the hauliers within a timeframe varying from one to three weeks. The reply could be of two types: either the parcel has been found and is thus returned to the customer in accordance with the normal procedure, or the parcel is declared lost, at which time La Boutique en Ligne Mistercredito informs the customer and makes a refund (billed amount) or ensures a second shipment. In any event, the choice is up to the customer.
Any delivered product must be the object of a control and eventual reserves on the carrier’s slip in the event of partial or total deterioration.
Failing any reserves, the product is considered to be in good condition and can be the object of no subsequent dispute.
All unclaimed parcels returned to La Boutique en Ligne Mistercredito can be sent out again at the cost of the recipient.
On receipt of the parcel, the customer must send to La Boutique en Ligne Mistercredito a claim of any product non-conformity, whether in nature, quality or quantity in relation to the information specified on the bill, by electronic mail. Any non-conformity claim not made within the rules defined above and within the fixed timeframe, cannot be taken into account, and releases La Boutique en Ligne Mistercredito from any responsibility via-à-vis the customer.
In the event of postal or haulier strikes, or any other event that is exceptional in nature, slowing down or preventing parcel delivery, La Boutique en Ligne Mistercredito will make every effort to inform the customer of the shipping state of his parcel.
If, for any reason whatsoever, the customer is dissatisfied with the product he has purchased, in accordance with article L120-20 of the Consumer Code, said customer has the right to renounce the purchase within 7 days following receipt of the parcel in question, the postmark taken as proof, as long as the product is returned in perfect resale condition, i.e. packed in its original packaging, complete and showing no sign of impact or malfunction.
A product is taken in its entirety, i.e. if the customer orders a pack and is dissatisfied with one of the components of said pack, he must nevertheless return the entire pack. La Boutique en Ligne Mistercredito reserves the right to return any incomplete parcel to the customer.
The customer bears the cost of the return and the parcel travels under his responsibility.La Boutique en Ligne Mistercredito advises the customer to pack the product carefully (both inside and out, the original packaging must itself be packed inside a carton adapted to transport), and to insure it. La Boutique en Ligne Mistercredito is not liable for any problem of impact or malfunction that occurred during shipment.
The customer must previously inform La Boutique en Ligne Mistercredito of his intention to return the parcel by electronic mail.
Subject to compliance with the previous conditions, a refund of the value of products as specified on the bill, this excluding delivery costs, will be made within 15 days following receipt of the product by La Boutique en Ligne Mistercredito.
In all cases, La Boutique en Ligne Mistercredito reserves the right to withhold the price of missing products.
La Boutique en Ligne Mistercredito Returns Department has nothing to do with breakdowns or malfunctions. Any appliance returned under these circumstances will be forwarded to the After-Sales Service and the procedures applied will be specific to this service.
Finally, La Boutique en Ligne Mistercredito advises the customer to make sure that nothing is left in the product, notably a photo, video, music, etc., before returning it. La Boutique en Ligne Mistercredito cannot be held liable for any loss of this data.
Some appliances sold on La Boutique en Ligne Mistercredito are guaranteed contractually by their respective manufacturer. The warranty contract is concluded between the customer and the manufacturer through the buying act, the bill of purchase taken as proof.
The customer benefits from the legal warranty described in article L L211-1 of the Consumer Code that resumes articles 1641 to 1648 of the Civil Code.
As a reminder, this guarantee is due by the vendor under 4 conditions:
- the product defect is hidden
- it is previous to entry into the sales contract
- it is so significant that the customer would not have purchased it, or would have offered a lower price
- that the action is brought within a short time as from discovery of the defect.
The Mistercredito Online Shop is released from its delivery obligations in the event of force majeure.
Before sending the product to the return service or the After-sales Service, the Mistercredito Online Shop advises customers to check that they have left no data or personal effect in the product and notably no photo, video, music, etc.
The Mistercredito Online Shop cannot be held responsible for any loss of data or personal effects.
The Mistercredito Online Shop declines all responsibility regarding the devious or incorrect use of the products ordered by customers
